Bequest Language

Below is language you can use to make a bequest to support our cause. A bequest allows you to continue to use the property you will leave to us during your life and make a lasting impact on our work after you are gone.

Below is language you can use to make a bequest to achieve your charitable goals through the Community Foundation. A bequest allows you to make a lasting impact after you are gone.

If you are considering a bequest but would like to ensure that your bequest will be used for a specific fund or purpose at the Community Foundation, please let us know. You can donate to either an existing fund at the Community Foundation, or create a new fund to meet your charitable intent. If you wish to create a new fund, please contact us so we can work with you to draft a fund agreement so we are prepared to handle your bequest according to your wishes.

1. Specific Bequest

If you are considering making an outright bequest to Kosciusko County Community Foundation, we recommend the following language:

Bequest of a Specific Dollar Amount

I hereby give, devise and bequeath _________ and No/100 dollars ($DOLLARS) to Kosciusko County Community Foundation, a nonprofit organization located at 102 E. Market Street, Warsaw, IN 46580, Federal Tax ID #35-6086777, to be held in a component fund known as the ________________ Fund.

Bequest of Specific Personal Property

I hereby give, devise and bequeath DESCRIPTION OF PROPERTY to Kosciusko County Community Foundation, a nonprofit organization located at 102 E. Market Street, Warsaw, IN 46580, Federal Tax ID #35-6086777, to be held in a component fund known as the ________________ Fund.

Bequest of Specific Real Estate

I hereby give, devise and bequeath all of the right, title and interest in and to the real estate located at ADDRESS OR DESCRIPTION OF PROPERTY to Kosciusko County Community Foundation, a nonprofit organization located at 102 E. Market Street, Warsaw, IN 46580, Federal Tax ID #35-6086777, to be held in a component fund known as the ________________ Fund.

2. Percentage Bequest

If you are considering making a bequest of a percentage of your estate to Kosciusko County Community Foundation, we recommend the following language:

I hereby give, devise and bequeath ____ percent (___%) of my total estate, determined as of the date of my death, to Kosciusko County Community Foundation, a nonprofit organization located at 102 E. Market Street, Warsaw, IN 46580, Federal Tax ID #35-6086777, to be held in a component fund known as the ________________ Fund.

3. Residual Bequest

4. Contingent Bequest

If (primary beneficiary) does not survive me, then I hereby give, devise and bequeath to Kosciusko County Community Foundation, a nonprofit organization located at 102 E. Market Street, Warsaw, IN 46580, Federal Tax ID #35-6086777, DESCRIPTION OF PROPERTY to be to be held in a component fund known as the ________________ Fund.

5. Restricted Bequests

If you are considering a bequest but would like to ensure that your bequest will be used for a specific purpose, please let us know. We would be happy to work with you and your attorney to help you identify ways to give and meet your charitable objectives. We will also work with you and your attorney to craft language to accomplish your goals.

If you are making a restricted bequest, we recommend that your attorney include the following provision to give Kosciusko County Community Foundation flexibility should it no longer be possible for Kosciusko County Community Foundation to use your gift as you originally intended:

If, in the judgment of the Board of Directors of Kosciusko County Community Foundation, it shall become impossible for Kosciusko County Community Foundation to use this bequest to accomplish the specific purposes of this bequest, Kosciusko County Community Foundation may use the income and principal of this gift for such purpose or purposes as the Board determines is most closely related to the restricted purpose of my bequest.
